Please Vote NO on S 870 because it includes the nuclear ADVANCE Act (S. 870 Division B). The S. 870 that passed the Senate as the ‘‘Fire Grants and Safety Act of 2023’’ was 3 pages long, and dealt with the commendable effort to provide funds for firefighters/emergency responders, and fire prevention and safety. But in the HOUSE, S. 870 has been co-opted as a vehicle for the nuclear ADVANCE ACT, a huge nuclear proliferation and power wish list which was added as Division B. The inclusion of the nuclear ADVANCE Act is an attempt to fast-track the deployment of new nuclear reactors and dangerous uranium fuel nationwide, export nuclear materials and technology, and redirect the Nuclear Regulatory Commission (NRC) to back off on its role to regulate to become a promoter (like the old Atomic Energy Commission which Congress replaced back in 1974). This is being done PRIOR to proper scientific and engineering vetting, meaningful public scrutiny and debate, and transparent fiscal analysis. One of the most dangerous parts of the bill is Sect. 501, which compromises the NRC's nuclear safety mandate, requiring NRC to "update its mission statement" to promote (rather than regulate) nuclear power. This would introduce exactly the conflict of interest between regulation and promotion that the Energy Reorganization Act of 1974 intended to prevent. The Act abolished the Atomic Energy Commission and created the NRC to be an independent regulator, and it assigned the R&D/promotion duties to the Energy Research and Development Administration (later renamed the Dept. of Energy). I am also concerned about: • the nuclear energy export provisions (Title I), especially those that distract NRC from its domestic nuclear safety mission (Sec. 101) and compromise nuclear nonproliferation programs (Secs. 103 and 105); • the Title II provisions subsidizing new reactors (especially the Sec. 206 provision requiring NRC to consider easing licensing of new reactors on brownfield/Superfund sites); • the Title III provision loosening restrictions on foreign ownership of nuclear infrastructure; and • the other Title V provisions that pressure NRC to cut corners on licensing (Sec. 505), environmental reviews (Sec. 506), and inspections and enforcement (Sec. 507). Vote NO on S 870 to stop this end-run around nuclear safety and security. I urge you to oppose S. 870, until and unless the nuclear ADVANCE Act is removed. Thank you,
